Hi all! I am writing to you from Arkansas today (headed towards Memphis tonight after a brief stop for dinner!)
First and foremost I want to say thank you for your patience with the new steps in our lab report publishing process.
In the past 24 hours we have published two new articles with lab reports. These are for products for which testing and reporting was fully funded by generous individuals in our community.
Thanks to additional gifted support from so many of you — since yesterday we also received enough in contributions to cover copyright filing fees for four of our lab reports. As a result we will be publishing four MORE reports very shortly (within the next 24 hours)!
Unfortunately, until we see justice served in this copyright case (in which an app is making literally millions of dollars annually using AI to scrape all of our copyrighted information from our website without our permission, and then charging thousands of people nearly $50 a year to see the information we provide on our website for free), we will need to continue raising at least this additional $65.00 per lab report copyright filing fee in order to be able to continue publishing otherwise not-yet-funded lab reports.
A friend raised the following question yesterday:
Q.Hey Tamara, why do you need to do copyright filings for each of your lab reports when everything published on the website is already – technically – copyrighted?
A: Well… we now have two copyright lawyers helping us with this and here’s what we have learned: Yes – there is the possibility of seeing damages recovered for copyright violations even if materials have not been filed with the United States Copyright Office…. HOWEVER, the damages become STATUTORY damages (and therefore much more enforceable) if a stolen lab report (or hundreds of stolen lab reports for that matter) is formally and officially filed with the copyright office.
Statutory Damages Definition:
Statutory damages are predetermined financial awards defined by law rather than calculated based on actual harm. They allow plaintiffs to recover compensation in civil disputes where calculating exact financial losses is impractical or impossible, primarily serving to compensate the victim and deter future violations.
Statutory damages both help cover any financial impacts AND are the best deterrent for future potential violations. Setting up a system that will deter future violations is a key factor in this case, as it is quite damaging to Lead Safe Mama, LLC when others publish our lab reports on their platforms and then misrepresent our findings (as they do!) — especially given those lab reports have our info (business name, address, website, phone number, etc.) all over them!
Hopefully that helps to explain why we need to formally register copyrights for each of our lab reports from now on (at least until we settle this case).
It is our hope that settling this legal case will actually help us to create a fund for formally copyrighting all of our lab reports into the future — so it is just this interim period (until we see justice served in this matter) that we need the community’s help with these fees (in order to continue publishing otherwise not-yet-funded reports). This is also why we have offered to accept funds given in support of this “project” as loans (as we expect we will be in a position to pay folks back for helping in this way at this time).

The four new pending articles are prepped and ready to be published and should be published either tonight or tomorrow. And again – we’re sending out a giant “Thank you!” to everyone who has contributed to make this possible. We have another four in the queue after that (again mostly Trader Joe’s products for which we have not otherwise raised any funding to cover the costs of testing and reporting), so if you are able to make a one-time contribution in support of our publishing of these new lab reports (specifically to help us cover copyright filing fees for four more reports), please do (more on that below).
