As anticipated, Primal Life Organic’s legal team sent me a “cease and desist” letter. Here’s their letter and my response.

  1. I’m a natural toothpaste lover, SLS gives me chin acne, use a Zn toothpaste myself. But, if you, and by “you” I am addressing the PrimalLife team, of Akron, Ohio. (Akron, where 17 pct of kids have lead poisoning. ) You, being:

    Jim Morrison, President
    Josh Felber, Chief Marketing Officer
    If “you” are trying to shutter this beleaguered lead safety activist with THREATS rather than simply discuss this potential hazard (in your own best interest), then you need to be out of the consumer product industry. Heavy metals in sediment not something you compassed? Seems pretty elemental. The only “business savvy” reply from you is “Welly well, we’ll contact an independent medical authority today about this toxin quantum, and if you’re right, we’ll work around the clock to get it off the shelves ASAP ourselves. Because we’re not trying to injure people and lose everything, including the respect of our loved ones, in a consumer class action.”
    (Heads up, Sean Southard, of PinoNicholson, PLLC of Winter Park, Florida. C&Ds aren’t T-shirts out of a cannon. You don’t want it to look like you’re laying ground for your future paycheck, when PrimalLife gets sued.)
    The lack of sophistication here vis a vis branding and business goodwill is next level. The public is completely over and done with crass entitlement and aggression of any kind from companies. Where there are so few activists available to stem the onslaught of dangerous garbage, trying to silence them out of hand with C&Ds is offensive to every US consumer. Just present your homework, and have a dialogue with Ms. Rubin, and if you have a valid counterargument supported by evidence, she clearly will post your data. Alternatively, if Ms. Rubin is correct, she will have done you a huge service, and you should make a prompt donation by way of thanks. Small businesses need to be trustworthy and accountable, or you undermine all small business.

    Some say that bentonite reduces lead. This study (https://www.ncbi.nlm.nih.gov/pmc/articles/PMC5632318/) showed that montmorillonite (aluminium phyllosilicate), a component found in bentonite clay, reduced lead concentrations in pig tissues. It seems bentonite clay is not 100% montmorillonite. It can be contaminated with lead.

  3. Why are they using an attorney in Orlando who is not barred in Ohio, when their company is also not registered in Florida? Seems wonky.

    you never state the form the lead
    “results” with the implication that my client’s products are unsafe and never disclose the difference
    between lead in a product meant for ingestion and one that should not be swallowed.1

    MY GOD, ITS F-ING LEAD!!! ARE THEY SERIOUSLY SAYING THAT IT’S OKAY TO HAVE LEAD IN TOOTHPASTE BECAUSE ‘YOU SPIT IT OUT’? Jesus H.. do they state that explicitly on the package. “has lead, make sure to rinse well and don’t swallow as it’s a toxic substance’??? Do they? WTF?

  5. I just read the attorney’s letter. The attorney states that you (Tamara) have claimed that the toothpaste has 7.000 ppb lead (etc.). Does the attorney not know that you are basing this off the company’s OWN 3rd party test results for their own product, and not from any testing of your doing?!?!? Were they not aware that these values came from the Toothpaste’s 3rd party COA, and not from your testing?
    They go on to list multiple other points that you didn’t do a video, or talk about calibrating your XRF, when NONE OF THOSE TEST RESULTS CAME FROM YOU!! They were their own test results!!
    This is seriously a very special kind of stupid indeed. I have no words…..
