If you love my work (or if you love me) you are going to want to read this. The State filed a motion to dismiss my entire Federal Civil Rights case. This is my attorney’s brilliant response.

My attorney just sent this to me today (link here and below). This is his full 32-page superbly-written response as filed with the courts on Saturday (1/29) – a response to the State’s “Motion for Summary Judgment” which was filed about a month ago (the State’s attempt to get my entire Federal Civil Rights case thrown out of court.) We shared it today in the car with the whole family (Len – my husband – and Colescott – my eldest son – took turns reading aloud as we drove south from Maine to Boston).

As we read the document ourselves for the first time today, my son Avi (17 years old this week!) was really engaged by what he heard — and asked, “…so legal battles are the telling of stories by each side – different interpretations of facts and events, and how they relate to legal precedents and the relevant law…and the best story wins?” He was riveted by the whole document and what it represents. Hopefully you may find yourself equally intrigued by the incredible-but-true story of the absurd events of the past 6 years of my life as it is told / re-told by my attorney in this document. Even though I have lived it, given the absurdity of it all it really seems more like fodder for a Coen Brothers movie to me! I cried at several points today while they were reading it – both in sadness, re-living the trauma of the situation as it unfolded but also tears of joy in response to my attorney’s brilliant and sound argumentation that clearly unpacks and lays out what a load of B.S. the State of Oregon is trying to pull!

Before you do dive into this document, please note that my attorney has been working for justice – just as I have [with relatively little monetary compensation so far (I send him what I can, as I can afford to from my advocacy earnings).] If anyone out there is in a position and inclined to help see this fight through to a jury trial, and a just outcome, please consider contributing via my GoFundMe OR (even better) making a short-term loan (of $1,000 or $2,000 or more) to my business (Lead Safe Mama, LLC) for the legal defense fund for this work. (Here’s a link with all the ways you can support this work). While I did manage to pay my attorney (Zack) $4,000 out of Lead Safe Mama, LLC earned income this week, that is all I could afford to cover for the time being – not nearly enough to cover the costs of preparing for the upcoming jury trial. I would love to pay him $5,000 or $10,000 more at this juncture, so I do not risk losing him.

Zack told me today that he may need to get a job working somewhere else to pay the bills, if we cannot muster another round of support in this very important fight. I am reaching out to you for help today because this is a fight not only for my civil rights as an advocate and a citizen, but for the civil rights of citizens and advocates/ activists everywhere in the face of overreach, abuse of power, and acts of injustice so often casually committed by agents and employees of State, local and federal government agencies against us — with the assumption of immunity/impunity for the direct and/or collateral mayhem and destruction to livelihoods, reputations, and families that may result from their actions.

Thank you for taking the time to read this “page-turner” – and thank you also for supporting the work of Lead Safe Mama, LLC in all the ways you do!

  1. Hi Tamara. I am a subscriber. I posted a question and now I don’t see it anywhere.
Can you tell me if Denby Stoneware from England contains lead? Specifically the Troubadour pattern. I’ve had it since the 70’s and it had held up beautifully. But I am concerned.
I will provide a photo is I can. No I can’t. But if you email a response with a location I can send a photo, I will.
I love the work you are doing.
    Thank you.
    Susan
